German Doctor’s Gagging Bid Rejected By Courts
A german doctor who killed a patient after confusing morphine for another drug has failed in a legal bid to stop the sons of the deceased patient talking to the media about the case.
Dr Daniel Ubani was struck off by the General Medical Council, but objected to the sons of David Gray calling him a “killer” or a “charlatan”.
A court in Germany rejected his case, but ruled that the brothers could not call Dr Ubani an “animal”. The ruling applies across the whole of Europe.
Rory Gray said he was happy with the verdict, saying the court’s ruling was a “fair result”.
He added: “It means that we can continue to speak the truth and inform people about the danger he presents.”
Mr Gray’s father David lost his life in 2008, when Dr Ubani was working at an out of hours medical practice. The doctor administered a dose of diamorphine that was 10 times the recommended amount.
Following the death, Dr Ubani received a nine-month suspended sentence from a German court after he admitted causing Mr Gray’s death by negligence.
